It is hereby announced in accordance with Article 73,Paragraph 3,Subparagraph 7 of the Property Management Regulations,Chapter 18,Article 2 of the Construction Permit Regulations,Chapter 18,Article 2 of the Construction Permit Regulations,Chapter 4 of the Housing Regulations,and Chapter 2,Article 2 of the Administration Regulations of High Frequency Noise Control of Shanghai.
Article 1 These provisions are enacted to standardize the management of construction and decoration work,create a quiet environment for office,and protect the legitimate rights and interests of citizens and legal entities
Article 2 Any construction and decoration work in office buildings in Shanghai shall abide by the provisions of this regulations.
Article 3 The construction and decoration work in the office buildings shall be divided into the next renovation work and minor renovation.
1. The decoration work is characterized by large area,great amount,and long duration.It mainly includes flooring,celling,wall,electrical,lighting,air conditioning,and other projects.
2. The minor decoration work is characterized by small areas,little amount,and short duration.It mainly includes partition,paving,furnishing,and refurbishing.
Article 4 During the construction and renovation of the office building,the following provisions shall be observed:
1. When the construction or renovation involves the replacement or modification of building structures,water supply and drainage,fire fighting,electrical,lighting,air conditioning,gas,and other projects,the unit responsible for operation and management of the building shall entrust a qualified enterprise to design and construct it,and shall complete the construction or renovation according to design documents.
2. If the construction or renovation of the office building involves the replacement or modification of the internal structure of the house,the external color of the house,the facade,and the appearance of the ancillary facilities,the construction unit shall obtain the approval of the property management unit and related administrative departments.
3. The construction and decoration work in the office building shall use standardized construction technology and materials with fireproof,moistureproof,and environmental protection.
4. The construction and decoration wastes shall be cleared away in a timely manner.During construction and decoration,it is forbidden to dump the wastes from high altitude,to occupy public facilities such as evacuation passage,safety passage,and fire equipment,and to affect the normal work.
5. The construction and decoration unit shall take necessary measures to prevent construction noise and dust pollution,and shall not affect the normal work of other units in the office building.
Article 5 During the office hours(8:3018:00) in the office building,it is forbidden to undertake the construction and decoration work that makes loud noise or vibration,such as electric hammer,brick cutting,or welding.
Article 6 During the nonoffice hours(6:008:30 and 18:0022:00) in the office building,it is forbidden to undertake the construction and decoration work that makes loud noise or vibration,except the work of earthquake resistance,antiflooding,antityphoon,fire prevention,emergency rescue,and safety protection.
Article 7 The noise and vibration caused by construction and decoration units in the office building shall conform to the regulations of administrative departments of Shanghai.
Article 8 The construction and decoration units shall abide by the supervision and management of the units responsible for operation and management of the office building and the administrative department of construction supervision and law enforcement,and shall accept the relevant penalties according to law.
Article 9 The property management units of the office building shall strengthen the supervision and management of construction and decoration work,and shall assist the administrative department of construction supervision and law enforcement in the management.
Article 10 The administrative departments of construction supervision and law enforcement shall supervise and manage the construction and decoration work of the office building according to law.
Article 11 The units responsible for operation and management of the office building shall publicize these provisions,and shall establish and perfect relevant rules and regulations.
Article 12 These provisions shall take into effective from July 1,2013.
